First Liberty Institute has submitted a friend-of-the-court brief to the Supreme Court on Abigail's behalf, urging them to protect parental rights in M.C. and J.C. v. Indiana Department of Child Services, which challenges Indiana's decision to remove a child from Christian parents due to their religious beliefs about sexuality. Abigail's experience parallels the trauma faced by M.C. and J.C. and highlights how many states are violating parental rights and targeting people of faith.

Yaeli faced depression, bullying, and confusion about her sexuality during middle school. Encouraged by her school, she joined an LGBTQ club without her mother's knowledge or approval. At 16, she was taken from her home and hidden for two days by a classmate's parent, who brainwashed her into making false accusations of abuse. Despite Abigail's pleas to treat Yaeli's severe depression, the state provided her with testosterone and separated her from her mother. During supervised visits, Abigail was forbidden from discussing her faith. The trans-advocacy group RISE even instructed her not to talk about God if she wanted to see her daughter.

Yaeli, emotionally and financially struggling, eventually took her own life. The California Department of Child and Family Services, disregarding Abigail's input and religious perspective, admitted to aggressively implementing gender-affirming policies. The state's erasure of parental rights and religious freedom is a direct attack on the family structure.

In their brief, First Liberty Institute argues that the First Amendment protects the religious liberty of families and that the state cannot interfere with the interpretation of religious beliefs. Parental rights and free exercise rights, especially for religious families, are closely linked. The Supreme Court now has the opportunity to protect parental rights and religious exercise by granting certiorari in M.C. and J.C. v. Indiana, providing hope for parents like Abigail.
