Low on law, high on theater. That’s the best way to describe Hunter Biden’s Capitol Hill stunt. He crashed a public meeting where the House Oversight Committee was voting on a resolution to hold him in contempt of Congress. This is ironic because the resolution was based on a subpoena that he had defied. In the federal justice system, defying a subpoena can lead to arrest, contempt charges, and even criminal prosecution. That’s why people usually comply with subpoenas. But Hunter Biden knows he’s playing with house money. He is confident that the Biden Justice Department, which scorns the Republican-controlled House, will not prosecute him.Democrats have been enjoying a two-tiered system of justice in the Biden-era. Democratic prosecutors have indicted former President Donald Trump multiple times while turning a blind eye to left-wing violence. The Biden Justice Department has intentionally let the statute of limitations expire on Biden family influence-peddling transactions and tried to make Hunter's tax and gun offenses disappear. Even with the recent tax indictment, it is widely believed that President Biden will pardon his son after the 2024 election. The ship of two-tiered justice has already sailed, and any additional damage it can do to Biden's reelection bid is negligible.
In exercising prosecutorial discretion, the Biden Justice Department can rationalize that the House subpoena was a political stunt, as they knew Hunter would refuse to testify. Republicans issued the subpoena to score political points, not conduct a good faith investigation. So, don’t hold your breath waiting for a big Hunter contempt indictment. But if you’re a Republican, every day the attention is on Hunter Biden is a bad day for the president.
