Federal Court Judge Richard Mosley stated that the decision to issue the proclamation lacked reasonableness and transparency. Deputy Prime Minister Chrystia Freeland defended the government's actions, claiming they had invoked the act as a last resort to secure and protect Canada's national interests. The government plans to appeal the ruling. Lawyer Paul Champ, representing Ottawa residents and businesses, expressed that the court clearly conveys the impact the Freedom Convoy trucks had on the lives of Ottawa residents and businesses. The protest initially targeted vaccine mandates for cross-border truckers but soon grew into a broader anti-mandates demonstration. The occupation of downtown Ottawa and Parliament Hill raised concerns about exacerbating the supply chain crisis. Trudeau invoked the Emergencies Act, allowing a powerful police crackdown on the protests and the forced removal of the vehicles blocking the streets. The act also allowed freezing the bank accounts of those suspected of orchestrating and participating in the protests. Mosley argued that the use of the act did not meet the requirements of a public order emergency. Mosley's ruling contradicted a federal inquiry in 2023, which found that while the invocation might be drastic, it was not dictatorial.
