A federal appeals court in Washington, D.C., recently found that some criminal defendants charged in connection with the Capitol riot on January 6, 2021, had their sentences improperly increased. The U.S. Court of Appeals for the D.C. Circuit ruled Friday that defendant Larry Brock’s sentence had erroneously included charges of "interference with the administration of justice." According to Circuit Judge Millett, who authored the court’s opinion, interference with Congress’ certification of electoral votes does not warrant a sentence enhancement.The appeals court upheld Brock’s conviction but disagreed on the sentencing, stating that the ‘administration of justice’ enhancement does not apply to interference with certifying electoral votes. Despite other aspects of Brock’s conviction being upheld, the court ordered a resentencing on the single "interference" charge. This ruling could potentially impact other defendants who received longer sentences due to the same charge.Larry Brock was initially arrested and charged with two offenses on January 6, 2021, but the "interference" charge was added later. He attended the "Stop the Steal Rally" and later entered the Capitol building, spending approximately 38 minutes inside. Brock’s actions were detailed in court, highlighting his participation in the riot and subsequent interaction with Capitol Police officers before leaving the premises.
