A member of the Massachusetts Air National Guard, Jack Teixeira, is seeking release from custody as he faces charges of leaking secret military papers. Teixeira argued that former President Donald Trump and his co-defendant, Walt Nauta, are free ahead of trial despite facing similar charges of mishandling classified documents. Teixeira has been in custody since April for allegedly publishing Pentagon secrets about the war between Ukraine and Russia and sharing sensitive material on a social media platform called Discord.
In May, Magistrate Judge David Hennessy ruled that Teixeira must remain behind bars due to concerns that he might flee the country or obstruct justice. However, Teixeira's lawyers are now requesting that a different judge allow him to be freed until his trial, proposing that he be released to his father with location monitoring and no internet access.
Teixeira's lawyers argued that he has no financial incentive to flee and posed a lower risk to national security compared to Trump and Nauta, who were not required to surrender their passports. They believe that the government's argument for Teixeira's detention is flawed, highlighting the disparate treatment of the cases.
Last month, Teixeira pleaded not guilty to six counts of willful retention and transmission of national defense information, each carrying a maximum sentence of 10 years in prison. Trump has also pleaded not guilty to charges related to the retention of classified documents.
Authorities accused Teixeira of sharing classified documents with other Discord users, starting in January. Teixeira, who worked as a cyber transport systems specialist, allegedly typed out classified documents and shared photographs of files marked "SECRET" and "TOP SECRET." His motivations were reported to be impressing his friends.
The prosecution argued that Teixeira may possess undisclosed material that could be of great value to hostile nation states. However, Teixeira's lawyers contested this, stating that there is no evidence suggesting that he is valuable enough for a foreign adversary to smuggle him out of the country.
