A federal judge has criticized the Biden administration's now-blocked migrant release policy, stating that a substantial minority of migrants failed to check in with Immigration and Customs Enforcement (ICE) as required. The policy, known as Parole with Conditions, briefly allowed the release of migrants into the U.S. without court dates due to overcrowding. However, within 24 hours, it was shut down after a lawsuit from Florida. The Department of Homeland Security released over 6,000 migrants under this policy, but a significant number did not comply with the requirement to check in with ICE within 60 days. Only 18% of the released migrants have been issued a notice to appear for immigration proceedings, while the whereabouts of the remaining 82% are either unknown or they are awaiting the issuance of a notice. The judge found this data troubling and criticized the lack of a plan to track down migrants who violate the conditions of their parole. The Biden administration has expanded the use of parole as part of its strategy to address the border crisis but has faced criticism for the lack of enforcement actions against those in violation. Despite the block on parole policies, the administration continues to parole migrants through ports of entry and has implemented a parole program for nationals from Cuba, Venezuela, Nicaragua, and Haiti. The administration claims it is expanding legal pathways to bring order to the southern border, and apprehension numbers have decreased in June compared to previous months.
