The New York Times reported that Weiss initially wanted to drop charges against President Biden's son but changed his position after IRS officials accused the Justice Department of interfering with the investigation. Honig called the DOJ's handling of the situation an "unholy mess" and specifically faulted Weiss for his actions. According to the reporting, Weiss first wanted to let the case go altogether, but political pressure forced him to backtrack and pursue misdemeanor pleas. However, the deal fell apart, and Weiss is now seeking to be called Special Counsel. Honig suggested that Weiss' decisions have been influenced by whistleblowers from the IRS. He also questioned why Weiss is being made Special Counsel now, after five years of the investigation, and criticized the DOJ for being inconsistent and not doing any favors for Hunter Biden or the whistleblowers. In July, Hunter Biden's plea deal collapsed in a Delaware courtroom after federal prosecutors confirmed they were still investigating him. However, a federal judge dismissed Hunter Biden's misdemeanor tax charges, and the Justice Department filed to dismiss the case ahead of a possible trial on his felony gun charge.
