America First Legal, Schaerr Jaffee, and Joel Ard have filed a lawsuit against Washington Governor Jay Inslee to block enforcement of S.B. 5599. The law allows shelters in Washington to provide sex transition services to minor children without the consent or knowledge of their parents. This includes potentially harmful procedures such as chemical sterilization and genital mutilation. Under the previous law, shelters were required to contact parents within 72 hours of the child's arrival and provide information about their condition. The only exception was if notifying the parents would subject the child to abuse or neglect. However, the new law expands the definition of "compelling reasons" and excludes parental notification when a child is seeking or receiving gender transition treatments. The Department of Children, Youth, and Families is also relieved of the obligation to notify parents in such cases. This creates a legal regime where the state can hide the location of a child receiving experimental gender transition treatment and facilitate the process, which is seen as state-sanctioned kidnapping and unconstitutional. The lawsuit argues that S.B. 5599 violates parents' due process rights, their First Amendment rights to free exercise and free speech, and their equal protection rights. It claims that the law interferes with parents' fundamental right to direct the upbringing of their children and to have custody of them. The plaintiffs are fighting against this government assault on the nuclear family and the systemic enticement of children to leave their parents for medical and social experiments.
